These Terms of Use govern access to and use of the PropertyMetrics NZ website and any tools, calculators, dashboards, data exports, and related services (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
The Services are operated by Property Metrics NZ Limited (NZBN 9429053321145, NZ company number 9391764), a company registered in New Zealand with its registered office at 39 May Street, Mount Maunganui 3116. References to "we", "us", or "PropertyMetrics NZ" mean Property Metrics NZ Limited.
If you are a consumer as defined under the Consumer Guarantees Act 1993 (CGA) and you are acquiring the Services for personal, domestic, or household purposes, nothing in these Terms limits your rights under the CGA or any other applicable consumer protection legislation. Our liability in those circumstances is limited to the extent permitted by section 43 of the CGA. If you are acquiring the Services for the purposes of a business, you agree that the CGA does not apply to the supply of those Services.
You agree to indemnify and hold harmless PropertyMetrics NZ Limited from any claims, losses, or damages arising from your misuse of the Services or breach of these Terms.
We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms. We may suspend or terminate access for security, legal, or operational reasons.
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
You must be at least 18 years old to use the Services. By accessing or using the Services, you represent that you meet this requirement.
PropertyMetrics NZ is an independent platform and is not affiliated with, endorsed by, or acting on behalf of Land Information New Zealand (LINZ), Stats NZ, GNS Science / GeoNet, the Ministry of Education, or the Ministry of Business, Innovation and Employment (MBIE). Government data is used under open licence terms where applicable.
Property boundaries, school zones, and hazard layers displayed on maps are approximate and should not be relied upon for legal, surveying, or boundary-dispute purposes.
We collect and process personal data — including search queries, property addresses, portfolio entries, and usage patterns — as described in our Privacy Policy. By using the Services, you consent to this collection and processing.
When you sign in with an account, your portfolio, saved properties, and profile details are stored securely in our cloud database (Google Cloud Firestore) so they are available to you on any device. You can delete saved properties at any time from your portfolio.
The Services may use cookies and similar technologies to maintain sessions, remember preferences, and analyse traffic. You can control cookie settings through your browser. For details, see our Privacy Policy.
Property analysis reports purchased through the Services are delivered as digital downloads (PDF). All sales are final once a report has been generated. No refunds will be provided for digital reports except where required by New Zealand consumer law.
Reports are licensed for your personal use only. You may not resell, redistribute, commercially exploit, or publicly share purchased reports without written permission.
We may collect contact details, property interests, and investment preferences for the purpose of connecting you with licensed real estate professionals, mortgage brokers, insurance advisors, and property investment specialists.
You will be given a clear opportunity to consent or opt out before any personal data is shared with third parties. You may withdraw consent at any time by contacting us.
Where we connect you with a partner such as a financial adviser, mortgage broker, or other professional, PropertyMetrics NZ may receive a referral fee or commission if you proceed with that partner. This does not cost you anything, you are under no obligation, and it does not affect the information or analysis we provide to you.
Paid subscription plans may be introduced in the future. Fees will be clearly displayed before any charges apply. Subscriptions will auto-renew unless cancelled before the renewal date.
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period. No partial refunds will be provided except where required by New Zealand consumer law.
Unauthorised automated access — including scraping, botting, reverse engineering, or circumventing rate limits — is strictly prohibited. We may block or terminate access for any account or IP address engaged in unauthorised automated activity.
The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, secure, or error-free access. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, internet outages, or third-party API failures.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights without our prior written consent.
