Terms of Use

These Terms of Use govern access to and use of the PropertyMetrics NZ website and any tools, calculators, dashboards, data exports, and related services (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Early access and scope

• The Services may be provided in early-access or beta form and may change, evolve, or be withdrawn without notice.
• Features, outputs, and availability may vary over time.

No financial, legal, or professional advice

• The Services are provided for general information and research purposes only.
• Nothing on the platform constitutes financial advice, investment advice, legal advice, tax advice, or a valuation.
• You are responsible for obtaining independent professional advice appropriate to your circumstances.

Accuracy, assumptions, and third-party data

• Outputs may rely on user inputs, assumptions, estimates, and third-party or public data sources.
• We do not warrant that any information is accurate, complete, current, or suitable for your purposes.
• You must independently verify all critical information before making decisions.

User accounts and access

• Where accounts or restricted features are offered, you are responsible for maintaining the confidentiality of your access.
• You must not share access credentials or allow unauthorised use.

Acceptable use

• You must not misuse the Services, attempt to bypass security, scrape data, reverse engineer functionality, or interfere with availability.
• You must not upload unlawful, infringing, misleading, or harmful content.

Intellectual property

• All intellectual property rights in the Services, including software, designs, branding, and content, remain with PropertyMetrics NZ Limited and its licensors.
• You may not copy, reproduce, resell, redistribute, or commercially exploit the Services except as expressly permitted.

Pricing, plans, and changes

• Pricing and subscription plans may be introduced or changed in the future.
• Any paid features will be clearly communicated before charges apply.

Limitation of liability

• To the maximum extent permitted by law, PropertyMetrics NZ Limited excludes liability for any loss or damage arising from use of, or reliance on, the Services.
• This includes indirect or consequential loss, loss of profit, loss of opportunity, and data loss.

Indemnity

You agree to indemnify and hold harmless PropertyMetrics NZ Limited from any claims, losses, or damages arising from your misuse of the Services or breach of these Terms.

Changes and termination

We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms. We may suspend or terminate access for security, legal, or operational reasons.

Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.

Age restriction

You must be at least 18 years old to use the Services. By accessing or using the Services, you represent that you meet this requirement.

Disclaimer of government affiliation

PropertyMetrics NZ is an independent platform and is not affiliated with, endorsed by, or acting on behalf of Land Information New Zealand (LINZ), Stats NZ, GNS Science / GeoNet, the Ministry of Education, or the Ministry of Business, Innovation and Employment (MBIE). Government data is used under open licence terms where applicable.

Property boundaries, school zones, and hazard layers displayed on maps are approximate and should not be relied upon for legal, surveying, or boundary-dispute purposes.

Data collection and privacy

We collect and process personal data — including search queries, property addresses, portfolio entries, and usage patterns — as described in our Privacy Policy. By using the Services, you consent to this collection and processing.

Portfolio data is stored locally in your browser by default. Where accounts or cloud features are offered, data storage terms will be clearly communicated.

Cookies and tracking

The Services may use cookies and similar technologies to maintain sessions, remember preferences, and analyse traffic. You can control cookie settings through your browser. For details, see our Privacy Policy.

Report licensing and refunds

Property analysis reports purchased through the Services are delivered as digital downloads (PDF). All sales are final once a report has been generated. No refunds will be provided for digital reports except where required by New Zealand consumer law.

Reports are licensed for your personal use only. You may not resell, redistribute, commercially exploit, or publicly share purchased reports without written permission.

Lead generation and sharing

We may collect contact details, property interests, and investment preferences for the purpose of connecting you with licensed real estate professionals, mortgage brokers, insurance advisors, and property investment specialists.

You will be given a clear opportunity to consent or opt out before any personal data is shared with third parties. You may withdraw consent at any time by contacting us.

Subscriptions, billing, and cancellations

Paid subscription plans may be introduced in the future. Fees will be clearly displayed before any charges apply. Subscriptions will auto-renew unless cancelled before the renewal date.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period. No partial refunds will be provided except where required by New Zealand consumer law.

API and automated access

Unauthorised automated access — including scraping, botting, reverse engineering, or circumventing rate limits — is strictly prohibited. We may block or terminate access for any account or IP address engaged in unauthorised automated activity.

As-is and as-available basis

The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, secure, or error-free access. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.

Force majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, internet outages, or third-party API failures.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

Assignment

We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights without our prior written consent.
